Lesbian Couple Share Baby Joy
SOME time in the coming few years, little Hunter will ask one of his parents where his daddy is.
"We said from the start that we would be as straightforward as we could be with him," says new mum Nikki Dance-Powell. "We'll just tell him that he has two mums instead."
Nikki, 35, and partner Rebecca Dance, 28, from Petrie, north of Brisbane, have been together for eight years.
Together they planned their baby, chose the sperm donor, supported one another through the pregnancy and, when Nikki gave birth, Rebecca was faithfully by her side.
The pair say they are equally maternal. When Hunter cries out at night, they both jump out of bed to feed him and, when he smiles, it brings tears of joy to them both.
"There was an instant connection between us when he was born. He is 10 weeks old now, and the longer he is around, the more intense those feelings get," Rebecca says.
But as far as the law is concerned, Rebecca has no parental rights. Only Nikki's name – which she changed so that they all shared Rebecca's surname – appears on the birth certificate, with a blank space where the father's identity would go.
Last week the New South Wales Government said it would amend its laws to give same-sex parents of children conceived through artificial fertilisation almost identical rights to those of conventional parents. The changes will mean that both mothers' names will appear on birth certificates, rather than just the biological parent.
"A blank space on a birth certificate is not a great symbol for anyone," Rebecca says. "It would make a difference (if her name was there as well). It would be important for him to know we are both there for him and it would be a recognition of my relationship with him."
Hunter was conceived by artificial insemination from the sperm of an anonymous donor via an agency in the United States, costing the couple about $2000.
After leafing through pages of detailed profiles, the pair settled on sperm from a tall, dark-haired, blue-eyed, university-educated family man from the state of Georgia. The only detail they don't have is his name.
"We chose him because he sounded a bit similar to me," Rebecca says.
"He said he was a little bit stubborn and he liked sports. He had a daughter, and he had dimples. He sounded like a good person."
Once Hunter is 18, Rebecca says, he will have the right to find out the full identity of his biological father and – if he chooses – try to contact him.
But, before then, there will be more pressing dilemmas to sort through. The two mothers acknowledge the need for a positive male role model in Hunter's life, a role which Rebecca hopes will be filled by her own father and friends.
Already, the pair have realised they must go to a Family Court to seek a co-parenting order, so Rebecca has the right to sign consent forms if Hunter had an accident at playgroup or needed an emergency operation.
They are in the process of amending their wills and their superannuation details to acknowledge Hunter and Rebecca as part of the family unit.
Figures from the Australian Bureau of Statistics, derived from the 2006 census, show there are 25,610 same-sex couples living in de facto relationships in Australia.
The statistics show Brisbane has 2601 same-sex couples, up from 1618 in 2001.
Lawyer Stephen Page, a partner specialising in equal rights for homosexuals at Harrington Family Lawyers, says the legal issues facing same-sex families invariably focus on the non-biological parent.
"That is where things can get very tough and there is no easy answer as to how their relationship with that child will be recognised in law.
"In Brisbane and Queensland, we have gay couples and lesbian couples having children together. This has to be recognised, but it appears the law is getting behind on the issue."
He says the legal issues would not be hard to fix and would require little more than political will.
"If the Premier Anna Bligh had that intention then she could make it happen," he adds.
But all these unique legal complications for same-sex parents will be rolled together with the rest of the issues that face all parents.
"Kids are picked on for not having the right shoes or being too tall or too short," Nikki says. "I don't think that the fact he has two mums will mean he is necessarily any more harassed at school.
"There is no traditional family unit any more – you have blended families, single-parent families, step families. We want him to know that family is just about having people that love you.
"Parents are just two people who look after him and love him, and that is all that any child would ever want."

Each workshop is designed to build on from the one before, so a commitment to following through on all five workshops is encouraged.

Cost: $10.00 member / $12 non member
Bring a loved one, a date , a group of friends or come alone because you never know who you’ll meet on the dance floor.
There will always be a friendly face to greet you at the door so don’t be shy and come and join us for a wonderful night out.
We'll have food and drinks to share and the bar will be open and well tended.
It doesn’t matter if you suit-up or frock-up, just be sure to show up as this is one of the best events on the calendar.
Weekly Dinners
Our weekly dinners are held every Tuesday at the Italian Club on Foster Street, Newmarket from 6.30pm.
There is an a-la-carte menu or a buffet for $11p/p or $20p/couple.
This is a friendly, come as you are, gathering to see old friends or meet new people.
Catch up on all the gossip and make plans to meet up at the next dance or picnic.
Share news of adventures or trials or achievements.
It’s a perfect setting for new comers to find out about us and to familiarise themselves with some friendly faces before coming along to a bigger event.
